3. Payment and Refund Policy
3.1 Payment Terms: Payment for our services is due upon mutual agreement and before the commencement of any work. We accept payments through all digital channels, and all fees are quoted and payable in the currency specified in the invoice.
3.2 Refund Policy: Foxigen IT Solutions adopts a no-refund policy. Once a payment is made, it is non-refundable. This policy applies to all services, including but not limited to website development, digital marketing campaigns, and consulting services.
4. Client Responsibilities
4.1 Information and Cooperation: Clients are responsible for providing accurate and timely information required for the successful completion of projects. Delays or issues arising from the client’s side may impact project timelines, and Foxigen shall not be held responsible for such delays.
4.2 Approvals and Feedback: Clients are required to provide timely approvals and feedback during the project. Failure to do so may result in project delays, and Foxigen shall not be held liable for any resulting consequences.
5. Intellectual Property
5.1 Ownership: All intellectual property rights related to the services provided, including but not limited to website designs, code, and marketing materials, remain the property of Foxigen IT Solutions unless otherwise agreed upon in a separate written agreement.
5.2 License: Upon full payment of fees, clients are granted a non-exclusive license to use the deliverables for their intended purpose. Foxigen retains the right to showcase the work in its portfolio and marketing materials.
6. Confidentiality
6.1 Confidential Information: Both parties agree to keep confidential information shared during the course of the project, including but not limited to business strategies, proprietary information, and project details.
6.2 Exceptions: Confidentiality obligations do not apply to information that is publicly available, already known to the receiving party, or independently developed without the use of confidential information.
7. Limitation of Liability
To the extent permitted by law, Foxigen IT Solutions shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our services, including but not limited to lost profits, data loss, or business interruption.
8. Governing Law and Dispute Resolution
These terms and conditions are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms shall be resolved through arbitration in accordance with the rules of Kalyan Court.
9. Changes to Terms
Foxigen IT Solutions reserves the right to update or modify these terms and conditions at any time without prior notice. It is the client’s responsibility to review these terms regularly.
